Sending Freight to the US?

The Transportation Security Administration (TSA) has introduced new cargo shipment requirements for Freight Forwarders handling shipments on passenger carriers traveling to or through the United States. These new regulations, effective 23 September 2024, apply to cargo originating from designated countries and mandate that shipments may only be accepted from shippers with whom the forwarder has an Established Business Relationship (EBR).

To comply with this directive, Freight Forwarders must confirm and verify that all shipments meet the new EBR criteria. Failure to provide the required confirmation could result in shipments being refused.

New EBR Requirements:

Under the TSA’s new mandate, Freight Forwarders must ensure that each master waybill (MAWB) is accompanied by a declaration confirming that all associated shippers fulfil at least one of the following criteria:

  1. Known Consignor Status – The shipper is recognised as a known consignor under the security program of a national authority.
  2. Pre-Existing Account – The shipper has an account with the forwarder that was established before 2 September 2024, and includes at least one of the following:
    • Shipping and billing address along with documented payment or credit history.
    • Documented sales history, including relevant contacts or activities.
    • Other documented business correspondence or records.
  3. New Shipper Verification – For shippers who became customers after September 2, 2024, the forwarder must have records of the following:
    • Business or corporate registration certificate, license, or record.
    • Business or corporate information, including name, address, phone number, and email.
    • Contact details of an authorised representative.
    • Payment information (e.g., corporate credit card details).
    • A signed contract between the shipper and the forwarder.

Compliance & Next Steps

To meet these requirements, Freight Forwarders must submit their confirmation via a Freight Forwarder Declaration Form when tendering cargo. It is also recommended that Freight Forwarders contact airlines in advance to confirm specific wording requirements for the EBR declaration, as minor variations may exist between carriers. Freight Forwarders should ensure compliance with TSA’s new regulations to avoid disruptions to cargo shipments.

A list of 55 countries now requires an Established Business Relationship declaration for shipments to the U.S., Canada and Australia.
